1. Acceptance of Terms

By accessing or using DearFutures (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and DearFutures.

2. Description of Service

DearFutures allows you to compose postcards and letters and schedule them for future delivery to a recipient via email. You choose a postcard template, write your message, provide sender and recipient contact information, select a delivery date and postmark location, and we deliver the postcard on the scheduled date.

4. User Responsibilities

By using DearFutures, you agree to:

• Provide accurate sender and recipient contact information.
• Only send postcards to individuals who you have a legitimate reason to contact. Do not use DearFutures for spam, harassment, threats, or any unlawful purpose.
• Review your message carefully before submitting, as it cannot be changed or cancelled.
• Not use the Service to send content that is illegal, defamatory, obscene, or violates the rights of others.
• Be at least 13 years of age (or the minimum age in your jurisdiction).

5. Delivery

We make every reasonable effort to deliver your postcard on the scheduled date. However, delivery depends on third-party email providers, and we cannot guarantee delivery if:

• The recipient’s email address is invalid or no longer active.
• The recipient’s email provider blocks or filters the message.
• Technical failures beyond our reasonable control occur.

In the event of a delivery failure, we will notify the sender via email and attempt redelivery where possible.

6. Sender Confirmation

Upon scheduling a postcard, we will send a confirmation to the sender via email. This confirmation includes:

• A unique tracking ID for your postcard.
• The scheduled delivery date.
• The recipient’s name and delivery method.
• The postmark location.

A second confirmation will be sent when the postcard is successfully delivered to the recipient.

7. Intellectual Property

You retain ownership of the content you create and submit through DearFutures. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of delivering your postcard. DearFutures’s templates, postmark designs, branding, and software are our intellectual property and may not be copied or redistributed.

8. Prohibited Uses

You may not use DearFutures to:

• Send spam, bulk unsolicited messages, or commercial advertising.
• Harass, threaten, or intimidate any person.
• Impersonate another person or entity.
• Send content that is illegal in your or the recipient’s jurisdiction.
• Attempt to gain unauthorized access to our systems.
• Interfere with or disrupt the Service.

We reserve the right to refuse service, terminate accounts, and report illegal activity to law enforcement.

9. Limitation of Liability

DearFutures is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, DearFutures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to emotional distress caused by delivered messages, failed deliveries, or unauthorized access to your content.

10. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

11. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
